Cancelling Timeshare Agreement
Timeshare owners interested in canceling timeshare agreements should proceed with caution; the process is a rather delicate one. The reason why canceling a timeshare is so difficult to do is because within your actual timeshare contract, the timeshare retailer who sold it to you put in as much complicated and convoluted wording and terms as possible with the goal of making it impossible for you to cancel your timeshare. When you buy timeshares, it is important to understand the contract so you don’t get blind sided by some exceptional fees. However, if you are simply aware of the fact that you have a right to cancel timeshares at all, then you are already ahead of the curve.
After you return home from the supposed 90 minute timeshare seminar, more than likely you are now the not-so-proud owner of a timeshare property you didn’t even know existed about an hour ago. Sitting around the house, allowed a clear moment to think it over, you may be reconsidering the tens of thousands of dollars you just spent in a moment’s notice. So what can you do? What are your options? Most people would be wondering if you could just cancel your timeshare, but how do you take back a timeshare?
Well, let’s start at the beginning. If you act on your need to cancel in a speedy manner there be no problem at all. From the day the timeshare contract is signed, you do have a window of opportunity of around three and fifteen days, (usually around seven to ten), to cancel your contract. This time period given to the recent timeshare owner by resort owners is called the rescission period. At this time, a timeshare buyer may actually call the company who sold them the timeshare back and just tell them that you wish to cancel the contract and that is the beginning of the end. A timeshare cancellation is still feasible and you no longer have to worry about the mounting costs associated with timeshare ownership.
Some of us, on the other hand, did not get the chance to realize our mistake before the end of our timeshare rescission time frame ended for many different reasons. Maybe we did not realize in time that we were not going to be able to afford such a huge cost, maybe we were never even told by the person who sold us our timeshare that there is such thing as a rescission period, or perhaps we simply have no time. Whatever your reason for not canceling your timeshare quickly enough is, you don’t need to worry because there are still other options available for canceling a timeshare. Some people opt to still call the company and ask them if they would be interested in buying back the timeshare contract, but this is rather highly unlikely to happen. Oddly enough, timeshare resale companies never seem to want the timeshare that they sold “at a loss” to the timeshare buyer back, no matter what the cost.
So, if you are still interested in returning your “timeshare investment,” there is another, more difficult, option you can use to get rid of your timeshare. You can try and prove that the company who sold you your timeshare did so by illegal practices. If you can prove that this did occur, than your best bet would be to call your local state Attorney General’s Office and report the timeshare company. If enough of your fellow upset timeshare owners have also complained as well, then it is possible to get a class action lawsuit against the company. Now, your attorney general will help you to cancel your timeshare contract. Unfortunately, this is something that is rather difficult to accomplish and it almost always takes years to do.
